Almost immediately after “This Is It” began streaming online on Monday, controversy followed. Fans and music experts quickly spotted striking similarities between the track and one recorded nearly two decades ago. On Monday afternoon Anka told The New York Times that he had written the song with MJ in 1983, and that the King of Pop recorded it as a duet with Spanish Harlem’s own Safire under the title “I Never Heard” in 1991.

Anka complained that he had not been contacted about the use of the song, and was not given proper writing credit for the single. By late afternoon Monday, John McClain, a record executive and producer named as executor of Jackson’s estate as an executor, promised to give credit to and pay Anka 50 percent of all profits.

The estate also released a statement that said in part: “The song was co-written by the legendary Paul Anka.”

“This Is It” will be available to buy as part of a two-disc album that hits the shelves internationally on October 26 and in North America on October 27 to coincide with the global limited release of the Jackson rehearsal footage concert film This is It, in theaters October 28.
