Guns N’ Roses Dr. Pepper Lawsuit (”Chinese Democracy” Free Soda Giveaway)

Looks like the commentors here at PopCrunch aren’t the only folks bubbling with rage over Dr Pepper’s botched free soda giveaway.

Guns N’ Roses singer Axl Rose is accusing the soft drinker manufacturer of profiting from the band’s name and then ruining its image after last weekend’s disastrous effort to give away a free 20-ounce soda to every person in America.

The soft-drink maker promised that it would give a free soda to everyone in the country if the band’s long-delayed Chinese Democracy album was finally released this year after notoriously being pushed back multiple times since 1994.

Chinese Democracy hit stores last Sunday, but Dr Pepper failed to make good on its promise, says Alan Gutman, who is representing Axl Rose and the rest of the band in the suit.

The Dr. Pepper Web site crashed from the influx of traffic during the 24 hours it was supposed to have offered the free soda to consumers, leaving most pop lovers unable to obtain the coupon needed to snag their soda.

“The redemption scheme your company clumsily implemented for this offer was an unmitigated disaster which defrauded consumers and, in the eyes of vocal fans, ‘ruined’ the day of ‘Chinese Democracy’s’ release. Now it is time to clean up the mess.”

The band’s legal team is demanding a full-page apology in The New York Times, Los Angeles Times, USA Today, and The Wall Street Journal; an expanded time period for fans to redeem their free soda; and “an appropriate payment to our clients for the unauthorized use and abuse of their publicity and intellectual property rights.”
