Dane Cook is set to be evicted from his West Hollywood apartment after a jury ruled his dog crapped in the communal garden.

Jurors decided by a majority of 11-1 that Dane’s miniature pinscher Beast consistently used community property as a personal toliet-and the actor refused to scoop the pet’s poop.

Dane took the matter to Landlord & Tenant court for a four day hearing after he was served with an eviction notice by landlord Scott Barry. Last Friday’s trial verdict means the Good Luck Chuck star’s landlord can legally oust him from the complex.
