Debbie Rowe, Michael Jackson’s former wife and the mother of his two older children, is reportedly “inconsolable” over news of the pop star’s death.

However, Rowe’s attorney Iris Finsilver tells PEOPLE the former nurse is “the legal parent” of Prince Michael, 12, and Paris, 11, and can gain custody of them if she so chooses.

Prince and Paris, as well as younger brother Prince Michael II, have been staying at the Encino, California home of their paternal grandparents, Joe and Katherine Jackson, since their father’s death on Thursday.
