Tequila — whose real name is Tila Nguyen –claims the X-rated footage has been obtained illegally because the video was stored on a computer she reported stolen in 2007. She’s threatening to sue the website’s ownerss if they fail to take down the tape.

“A police report has been filed for Tila’s stolen laptop computer which contained that specific clip. I am currently in the process of sending a cease and desist letter and a notice of intent to sue if (the footage) is not removed,” Cyrus Nownejad, Tila’s attorney, told TMZ.com Tuesday.

The leaked footage is one of several scandal plaguing the petite reality personality, who sparked fears for her mental health just last week after she stripped naked and masturbated with a tampon during a bizarre live show on Ustream.

Tila was hospitalied in September following an alleged altercation with her ex-boyfriend, San Diego Chargers linebacker player Shawne Merriman, who she accused of choking and attacking her. No charges were filed, but the star is now suing him for $1.5million.

Merriman was arrested early Sept. 6 after reality personality Tila Tequila (whose real name is Tila Nguyen) accused him of choking and throwing her while she was at his Poway home. Tequila signed a citizen’s arrest warrant accusing Merriman of battery and false imprisonment.

The Chargers star, 25, said he was trying to prevent Tila from leaving because she was too drunk to drive back to her home in Los Angeles. Tequila’s attorney called that explanation a “spin” — albeit one the D.A.’s Office found satisfactory. The San Diego District Attorney declined to prosecute the case, infuriating the pint-sized MySpace pinup.

In the complaint filed in San Diego County Tuesday, the former star of MTV’s A Shot At Love…..accuses the NFL star of assault and included photographs exhibiting bruises as evidence. Tila’s lawyer stresses the physical differences between the pair—Merriman stands 6-foot-4 and weighs nearly 280 pounds, while Tila is just 4-foot-11. Tila Tequila is seeking $1.5 million in punitive damages.

The auction continues through Nov. 7.

We strongly feel that justice has not been served in this matter.

“Obviously, The San Diego Charger’s NFL franchise brings millions of dollars in revenue to the city of San Diego, and it seems clear that other interests are being served by the DA’s office than the upholding of the law. A young woman was violently beaten and choked, and the physical evidence is both overwhelming and disturbing. Tila’s account of the events has remained consistent from the beginning, while Merriman’s story has changed repeatedly,” the statement continued.

“Just because the DA has made this reckless decision doesn’t mean that justice will not be served in this case. No one is above the law. Tila Tequila will immediately begin pursuing civil charges against Mr. Merriman and she will have her day in court.”

The pair had been dating since July.

Tila a citizen’s arrest warrant charging Merriman with felony counts of battery and false imprisonment. On Friday afternoon, Dumanis said there is insufficient evidence to prove beyond a reasonable doubt that Merriman committed a crime.

“This case is now closed,” the DA said in a statement.
