Assault charges against actor Kiefer Sutherland have been dropped.
The 24 star, 42, was charged with third degree assault after allegedly headbutting Proenza Schouler designer Jack McCollough and breaking his nose during a party in New York in May. Kiefer is now in the clear after McCollough refused to co-operate with prosecutors.
Several weeks after the incident, the pair issued a joint statement saying they had resolved their differences.
Manhattan District Attorney spokeswoman Alicia Maxey Greene confirmed that all charges in the case have been dismissed; a statement issued Tuesday reads: “We declined to prosecute after a full investigation. And that included speaking to the complaining witness who was quite uncooperative. Therefore, the D.A. declined to prosecute.”
On NBC’s Late Night Thursday, host Jimmy Fallon managed to get Kiefer Sutherland talking about his most recent criminal collar for headbutting a designer at the MET Costume Gala afterparty in New York City earlier this month.

On Monday, lawyers for actress Brooke Shields released a statement in response to reports that the witnessed the alleged argument — and subsequent headbutting –between Kiefer Sutherland and fashion designer Jack McCollough that lead to the 24 star’s collar on third degree assault charges last Friday.

A lawyer for fashion designer Jack McCollough, who was allegedly headbutted by Kiefer Sutherland at a party in lower Manhattan Monday, is slamming reports that he provoked the actor. On Wednesday, The New York Daily News alleged that the assault — which left McCollough with a broken nose — began after the fashionisto bumped into fellow guest Brooke Shields, prompting Kiefer to confront him.
“Anyone who knows Jack McCollough knows that he would not hurt a fly,” a rep for McCollough, who heads NYC’s prestigious Proenza Schouler fashion house tells PEOPLE. “All we can say at this point is that he was the victim of a vicious, violent, unprovoked assault and that the matter is in the hands of the authorities.”
The NYPD is investigating the incident. Kiefer, the star of FOX’s 24, is currently on probation in California stemming from his 2007 collar for DUI.

Kiefer Sutherland will be released from jail on Monday, the Glendale Police Department confirms.”He will most likely be released in the early morning, according to authorities. The “24″ star checked into jail in Glendale, CA in December to serve a 48-day sentence stemming from the most recent in a series of DUI arrests.
