The parents of the woman killed in a car accident caused by R&B singer Brandy filed a $50 million lawsuit against the singer last week, but some legal digging has resulted in questions into whether or not Mom and Dad have the legal right to sue.

Awatef Aboudihaj was a married mother of two. Under California State law, only the husband, not the parents, can sue for wrongful death.

The parents’ lawsuit was allegedly filed without consulting first consulting their son-in-law. Ms. Aboudihaj has been living in the States for eleven years. Her parents live in Morocco and had little contact with their American daughter.

The victim’s husband is being represented by Los Angeles attorney Bill Sayed. Sayed says he is currently investigating Brandy’s net worth and says the matter “will be resolved by settlement or jury verdict.” Sayed would not say how much money he’ll be demanding, but said it will probably be a combination of Brandy’s insurance policy limit — plus something additional from the singer.

Brandy’s former fiance the New York Knicks’ Quentin Richardson recently spoke out on her behalf:

“It isn’t right,” Q said. “It was a terrible accident. Accidents happen every day. People are making a bigger deal out of it because she is who she is.”
